Terms of Service
§ 1. General provisions
- These Terms set out the rules for concluding and performing contracts for the calibration of televisions, projectors and monitors under the SkalibrujTV brand directly between the Client and the Service Provider, and the rules for using the contact form on the website calibratetv.co.uk.
- The Service Provider is the trader named in the Order Form: Maciej Koper, trading as SKALIBRUJTV.PL Maciej Koper, NIP (Polish tax identification number) 5342546354, or Paweł Koper, NIP 5342583266, or both of these traders acting jointly as partners in Calibrator.pl Maciej Koper, Paweł Koper s.c. (a civil-law partnership under Polish law, spółka cywilna), partnership NIP 5342583415. The technician identifies the specific Service Provider to the Client before the contract is concluded; the Service Provider’s details are stated in the Order Form and on the invoice or receipt. Correspondence address: ul. Warszawska 112, 05-090 Jaworowa, Poland, e-mail: info@skalibrujtv.pl, tel. +48 22 770 77 77.
- Definitions:
- Client – a person who orders a service from the Service Provider.
- Consumer – a Client who is a natural person ordering a service that is not directly connected with their business or professional activity.
- Service – calibration of the Client’s device within the scope agreed in the Order Form.
- Order Form – the document signed by the Client before the Service begins, specifying the scope and the price (template: Annex 2).
- Calibration Certificate – a report containing measurements of the device before and after calibration, issued by the Service Provider.
- The provisions on the right to cancel the contract also apply to a natural person (sole trader) concluding a contract directly connected with their business activity, where the contract is not of a professional nature for that person, to the extent provided for in Article 7aa of the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta). The other statutory rights of such a sole trader arise from the applicable provisions of law.
§ 2. Contact form
- The Service Provider makes available on the website calibratetv.co.uk a free contact form for expressing interest in the Service or asking a question.
- Sending the form is not an order and does not result in the conclusion of a contract for the provision of the Service. The Service Provider’s scheduling team then calls the user to outline the proposed scope and price and to arrange a visit. The call does not oblige the Client to purchase the Service; the contract is concluded in accordance with § 3.
- To use the form, the user needs a device with internet access, an up-to-date web browser with JavaScript enabled, and an e-mail address or telephone number.
- Sending unlawful content through the form is prohibited.
- The contract for the use of the form is concluded when the form is sent and ends when a reply is given or when the user indicates that they no longer wish to be contacted.
- Complaints concerning the operation of the form may be sent to info@skalibrujtv.pl. The Service Provider replies within 14 days.
§ 3. Conclusion of the contract
- The form and the telephone call serve to obtain information about the Service and to arrange a visit. Providing information on the proposed scope and price and booking an appointment do not result in the conclusion of a contract for a paid Service or in any obligation to purchase it.
- Before the contract is concluded, during the visit, the technician presents to the Client the details of the specific Service Provider, the scope of the Service, the total price and the method and time limit for payment. The Client receives these Terms together with the information on the right to cancel and the model cancellation form as PDF files sent to the e-mail address provided, if the Client agrees to receive them in this format. If the Client does not choose PDF, or if delivery of the documents in this form is not possible, the Client receives them on paper. The Client has the opportunity to read the documents before signing the Order Form.
- The contract is concluded on site when the Order Form is signed by the Client and by the technician authorised to act on behalf of the indicated Service Provider, before the calibration begins. Before work begins, the Client receives a copy of the signed Order Form: as a PDF by e-mail with the Client’s consent, or on paper. The choice of the form of the documents is voluntary and is neither consent to marketing nor a request for the Service to begin early.
- Until the contract is concluded, the Client may decline the Service free of charge, even after the technician has arrived. In that case, no fee is charged for the booking, the cancellation or the technician’s visit.
- The Service may begin before the end of the cancellation period only at the Consumer’s express request, recorded on a durable medium, in accordance with § 6. Neither arranging the visit nor signing the contract replaces that request.
- Any extension of the scope of the Service or change of price requires agreement with the Client and confirmation in the Order Form before the additional work is performed.
§ 4. Prices and payment
- Prices in the price list on the website calibratetv.co.uk are given in pounds sterling (GBP) and include VAT.
- Travel within Poland is free of charge. Visits in the UK and Ireland, other services outside Poland and services marked in the price list as “individual quote” are priced individually before the contract is concluded.
- Discounts for the calibration of several devices or modes are agreed individually before the contract is concluded.
- Payment is always made after the Service has been performed: in cash to the technician or by bank transfer on the basis of an invoice, within the agreed time limit stated on the invoice. The Service Provider issues an invoice or a receipt.
§ 5. Performance of the Service
- The Service is performed at the place indicated by the Client, on the agreed date, between 8:00 and 20:30.
- The Client provides the technician with access to the device, a power supply, the remote control and, for projector calibration, the ability to darken the room.
- Calibration usually takes 50 to 90 minutes. Additional modes and high-end projectors may extend the visit.
- Using measuring instruments, the technician adjusts the device to the picture standards appropriate for the modes being calibrated, using the user menu or a network protocol. The technician does not use the service menu. The result depends on the adjustment capabilities of the given model and unit.
- After the Service has been performed, the Client receives a Calibration Certificate containing the measurement results and information enabling the Client to restore the calibration settings on their own if they are lost, including where calibration was performed via a network protocol.
- If, before or during calibration, it turns out that the device is damaged, the technician informs the Client and does not continue the calibration. The Client does not pay any charges for that visit, including for travel, diagnostics or the part of the work already performed.
- The Service Provider is not liable for faults of the device unrelated to the Service performed.
- The individual set of settings provided as part of the Service is prepared for a specific unit of the device. The Client undertakes not to publish that set, resell it or pass it on to third parties, including free of charge, for use on other devices without the Service Provider’s consent. This restriction does not cover publicly available information or settings determined by the Client on their own.
- Point 8 of this § 5 does not restrict the use of the Client’s own device, making and keeping copies of the settings for the Client’s own needs, using the help of household members or a repair service, passing on the settings together with the calibrated device, or disclosing information necessary to file a complaint, obtain an opinion on whether the Service was performed correctly, or pursue the Client’s rights. It does not prohibit describing and reviewing the Service.
§ 6. Right to cancel
- The Consumer may cancel the contract without giving any reason within 14 days of the day on which it was concluded.
- To cancel the contract, the Consumer sends a cancellation notice, e.g. by e-mail to info@skalibrujtv.pl or by post to the Service Provider’s address. The Consumer may use the model form (Annex 1), but this is not obligatory. To meet the deadline, it is sufficient to send the notice before the cancellation period expires.
- The Service Provider refunds the payment received to the Consumer within 14 days of receiving the cancellation notice, using the same means of payment, unless the Consumer has expressly agreed to another means of refund that does not involve any costs for them.
- The Service Provider begins the Service before the end of the cancellation period only at the express request of the Consumer, made in the Order Form before the Service begins.
- If the Consumer cancels the contract after making such a request but before the Service has been fully performed, the Consumer pays for the services provided up to the time of cancellation, in proportion to the scope of the contract.
- The right to cancel does not apply if the Service Provider has fully performed the Service with the express and prior consent of the Consumer, who was informed before performance began that they would lose the right to cancel once the Service had been performed, and who acknowledged this.
§ 7. Satisfaction guarantee
- The satisfaction guarantee covers Services ordered directly from the Service Provider.
- If the Client does not notice a difference after calibration, or is not satisfied with its result, the Client may report this to the technician on site or within 14 days of the Service being performed, by e-mail to info@skalibrujtv.pl or by telephone.
- If the Client chooses a refund without a follow-up visit, the Service Provider refunds the full payment for the Service within 14 days of the report, using the same means of payment. If the Client reports dissatisfaction on site before payment and chooses a refund, the Client does not pay for the Service. In the case of a voluntary follow-up visit, point 5 of this § 7 applies.
- The condition for using the satisfaction guarantee is the removal of the settings made as part of the calibration before the refund is received or before the Service Provider waives payment. On site, the technician removes them; after the visit has ended, the Client does this following the instructions provided by the Service Provider. This does not require another visit or a full reset of the device to factory settings. In an individual case, the Service Provider may waive the requirement to remove the settings in the Client’s favour.
- The refund is not conditional on a further visit by the technician. Instead of an immediate refund, the Client may voluntarily choose a free follow-up visit to correct the settings. If the Client is still not satisfied after that visit, the Client retains the right to a refund, even if the follow-up visit took place more than 14 days after the calibration. In that case, the Service Provider refunds the full payment for the Service within 14 days of the renewed report of dissatisfaction, subject to the condition in point 4 of this § 7. The Client is not obliged to accept a follow-up visit.
- The satisfaction guarantee is a voluntary commitment of the Service Provider. It does not exclude or limit the Client’s statutory rights, including the right to cancel and the right to make a complaint. The condition in point 4 of this § 7 applies only to the satisfaction guarantee and does not impose additional conditions on the exercise of those statutory rights.
§ 8. Complaints
- If the Service has not been performed in accordance with the contract, the Client may make a complaint by e-mail to info@skalibrujtv.pl or by post to the Service Provider’s address.
- The complaint should contain the Client’s details, the date of the Service, a description of the problem and the expected way of resolving it.
- The Service Provider replies to a Consumer’s complaint within 14 days of receiving it, on paper or another durable medium, e.g. by e-mail. Failure to reply within that time limit means that the complaint is accepted.
- The Client’s rights in the event of non-performance or improper performance of the Service arise from the provisions of law, in particular the Polish Civil Code of 23 April 1964 (Kodeks cywilny) and the Consumer Rights Act. These Terms do not limit them.
§ 9. Out-of-court dispute resolution
- The Consumer may use the free assistance of a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or of consumer organisations.
- The Consumer may apply to the voivodeship inspectorate of the Trade Inspection (wojewódzki inspektorat Inspekcji Handlowej) for mediation or to a permanent consumer arbitration court.
- The Service Provider agrees to participate in out-of-court dispute resolution, in particular before the Permanent Consumer Arbitration Court at the Masovian Voivodeship Inspector of the Trade Inspection in Warsaw (Stały Polubowny Sąd Konsumencki przy Mazowieckim Wojewódzkim Inspektorze Inspekcji Handlowej w Warszawie, wiih.org.pl). The Service Provider also provides this information in its reply to a complaint that has not been upheld.
§ 10. Personal data
The rules for processing Clients’ personal data are described in the Privacy Policy available on the website calibratetv.co.uk.
§ 11. Final provisions
- These Terms are available on the website calibratetv.co.uk in a form that allows them to be saved and printed, and the Client also receives them before the contract is concluded, in accordance with § 3. Sending these Terms earlier together with the confirmation of the visit date does not result in the conclusion of a contract for a paid Service.
- The Service Provider may amend these Terms. Contracts concluded before an amendment are governed by the Terms as worded on the date the contract was concluded.
- These Terms do not exclude or limit the Consumer’s rights arising from mandatory provisions of law.
- Polish law applies to matters not regulated herein. The choice of Polish law does not deprive a Consumer whose habitual residence is in another country of the protection afforded to them by provisions of the law of that country that cannot be derogated from by agreement (Article 6(2) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I)).
- These Terms (version of 5 November 2026) apply from 5 November 2026 to contracts concluded from that day. Contracts concluded earlier are governed by the version in force on the day they were concluded; earlier versions are available on request at info@skalibrujtv.pl.
